Just over a month after the First Street Grill’s final New Years Eve bash, another popular eatery on the Intracoastal Waterway closes its doors for the last time. The Lighthouse Grill, located at the San Pablo River bridge on Beach Blvd. has been sold to Chase Properties, Inc., whose plan is to offer multifamily housing with Intracoastal access on the 2.4 acre waterfront site. The new development, called Lighthouse Point, will consist of 37 townhouses designed in a West Indies tradition, and will sell from $650,000 to 1.5 million. Residents will also have the opportunity to own a boat slip on the property. After denying a proposal to construct an 80’ high, 94 unit condominium on the property two years ago, the city of Jacksonville Beach approved this project as the buildings fall under the cities 35 foot height limit, a restriction passed overwhelmingly by voters in the 2004 election that has until now been seldom enforced. The trend in Jacksonville Beach has been for developers to buy up large parcels of land, tear down the existing structures, and put up 7 to 10 story condominiums. As a result, many of the popular restaurants and night spots that helped define the character of Jacksonville Beach have disappeared. The most recent casualty was the First Street Grille, an oceanfront eatery and gathering place at 7th Ave. North. First Street Grille closed on January 1st after hosting a huge new year’s party attended by many local patrons of the establishment. First Street Grille will be fondly remembered for its excellent Florida cuisine, it’s popular happy hours, and for the dancing behind the dunes to the tunes of live oldies bands. A circuit judge ruled in October that the developer who owned the property, Lee Underwood, had vested rights in the parcel because his decision to purchase the land was based on the government’s position about the properties present and future status. A similar case was decided on January 9th, allowing developer Scott Gay the go ahead for a 10 story condominium at 10th Ave and 1st Street. Several other property rights cases are currently pending in the courts. Arising from the dust of the First Street Grille will be the Acquilus III, a seven story oceanfront condominium. Underwood also owns the property across the street on which the Dolphin Depot is located. An old two story beach house that was transformed into a restaurant, the Dolphin Depot is a popular upscale dining establishment with a very creative menu. According to the same judge that ruled on the First Street Grille property, the rights for this parcel are not vested. Nevertheless, one could safely assume that the Dolphin Depots days are also numbered. In early 2004, a proposal to develop Beach Marine, the public marina across the street from the Lighthouse Grill, into a 550 unit condominium resort and private yacht club was soundly defeated by city council. As a result spawned the group Beaches Watch, a collection of Jacksonville Beach citizens that began the citizen’s initiative, a referendum requiring a city wide height limit of 35 feet on all new construction. The city council proposed a similar amendment, but would allow high rise construction on the oceanfront only. In November, the citizens initiative won by an overwhelming majority of over 70%. High rise construction and development in general has by no means slowed in Jacksonville Beach since the vote. Seven to ten story condominiums are presently being erected from 3rd to 1st Streets as investors continue to win their vested property rights in the courts. While Jacksonville Beach is quickly becoming a world class destination, many of the locals will have to find alternative places to meet and hang out, perhaps going north out of the city to Atlantic and Neptune Beach where the casual ambience and beaches lifestyle does not seem to be threatened.

There s help for asthma in yoga
: Perhaps it was predestined that I should have had asthma as a kid, discover Yoga as an adult, correct my respiratory health with it and now be blessed to write about my experiences with using Yoga (amongst other things) to control my asthma symptoms. If this is the case, then I am honored. Either way it goes, I can say with much confidence that based on my experiences, one helpful exercise for alleviating Asthma symptoms and dealing with its many inconveniences is Yoga. Owing to its gentle poses and stretches and the deep breathing involved in Yoga, certain poses-when used correctly-can be very helpful for smoothening the chronic inflammation of the bronchial tubes (airways) that causes swelling and narrowing (constriction) of the airways as is the case in Asthma patients. Furthermore, when using Yoga as an exercise for asthma control, one need not worry about the common exercise-induced asthma attacks that may come as a result of vigorous activity as these poses are very calm and involve very little motion…hey, it’s Yoga after all. Now, friends, based on my experiences and several studies that support these facts, the following poses can be a powerful add-on therapy to reduce the frequency and intensity of asthma attacks as well as to decrease medication use. The Shoulder Stand & It’s Counter Poses for Asthma. Inversion poses in yoga drain excess mucus from the lungs and balance the immune system. Now, let me introduce you to perhaps the simplest of these poses, the shoulder stand pose. Although the Shoulder-Stand has been coined by several Yoga sages as a near panacea or cure-all, as far as Asthma is concerned, it is indeed very helpful in regards to relieving excess encumbrances in the respiratory organs and owing to its deep breathing, it increases the lung’s airflow, capacity, stamina and efficiency. Here comes the best part, its counter poses. You see, some yoga poses, owing to the execution of them that is, have to be offset by a pose in an opposite spinal direction (another subject, but hopefully you get the gist). Now friends, this Shoulder-stand pose has 2 main counter-poses: the Bridge and the Fish Poses. (No worries they are very simple to perform.) Both of these poses are back bending postures that open up the chest improving both lung and heart functioning. As a matter of fact, the very last pose (the fish pose) is one of the specific poses mentioned by Sri Swami Devananda and IBS Iyengar (two of the most authoritative figures in modern day yoga) as being specifically useful for removing spasms from the bronchial tubes and thus relieving Asthma. Other Helpful Poses: There are other poses such as the forward bends which you can practice specifically if it is more difficult to inhale. These include the Head-knee Pose (Passchimothanasa) and it basically involves grabbing your toes, ankles or feet with the head lowered as far as possible to touch the knees. Now, friends, remember I mentioned counter-poses right? Well, for this particular pose, its counter-poses basically are backward bending poses that include the Incline Pose and Bow Pose. Both of these (especially the latter) open up the chest and should be practiced to aid with exhaling during asthma attacks. Last, but not least is the simple, yet extremely effective Relaxation Pose. Yes, you guessed it right, just simply lie flat on your back and breathe in a controlled and rhythmic pattern. By practicing rhythmic, controlled breathing techniques daily, the respiratory muscles and lungs develop the ability to breathe more slowly all the time, meaning less stress on the airways in general. In addition to these poses, let me briefly mention the ‘Bellow’s breath exercise’ (a yoga breathing exercise) as this helps tremendously. As the name may suggest, it involves purposely pumping the stomach in an inward motion and exhaling through the nose simultaneously in controlled movements. This removes spasms and tones up the respiratory system significantly. At this point, it must be mentioned that Yoga does call for a healthy diet in its use and as a physical and spiritual system; it does call for a mostly vegetarian diet. Friends, for asthma problems, you may want to strongly consider this as giving up all processed foods and animal products such as meat, milk, eggs and the like from your diet is a must and a fact that has been in effect in several programs aimed at correcting respiratory health such as the "Breath Retaining Program For Asthmatics" developed by the Russian, Dr. Buteyko. Within weeks of adhering to this advice, many a chronic asthmatic has been able to give up the use of ventolin inhalers. So the next time asthma sends you to the doctor, you may do well to ask for a new prescription for asthma treatment-Yoga. I believe it won’t hurt and possibly could help you immensely.
Maintain your family s style between salon visits
Tired of dragging the whole family into the salon for high-priced haircuts? You have to round up the kids, pile them into the car - and then make sure they don't destroy all of the magazines as they await their turns with the stylists. What if you could keep their hairstyles looking "salon fresh" between visits? It's easier than you might think. Have everyone in your family follow these simple guidelines to extend the interval between salon visits. * Shampoo with cool or warm water. Shampooing with hot water can strip hair of natural oils, leaving you with a dry scalp. Massage and evenly distribute just a quarter-size amount of shampoo into hair, then rinse. And never shampoo twice unless your scalp is oily. * Condition. Hair needs moisture, just like skin does, but your scalp only needs conditioning if it's dry. So apply just a small amount of conditioner from the middle of the hair shaft to the ends. Leave the conditioner on for a few seconds, then rinse thoroughly. * Detangle. Use your fingers or a comb to detangle hair; a wide-tooth comb works best. Start from the ends and work up to get knots out a few inches at a time. Never brush hair until it is dry. * Cut it yourself. You can save money and time - and maintain your family members' freshly groomed styles - by trimming hair at home. A new tool from Wahl Clipper Corp., a leading manufacturer of professional beauty products, is helping consumers overcome their fears of making hair-cutting mistakes. It's called the Comb'n Cut, and those who use it are doubling the amount of time they're able to wait between hair appointments. The blade's "mistake free" technology is suitable for blending, tapering and shaping hair.
Disaster recovery more than meets the eye
As the Vice President of Operations for an online retailer of contact lenses, I am used to the potential problems related to doing business on the World Wide Web. Like any other online retailer, we have a responsibility to our customers to maintain their personal and payment information with the strictest of confidence and within regulatory guidelines mandated by our government. Security is a top priority, as it should be for any business who, by the very nature of the marketplace, exposes itself to the potential hazards of doing business in cyberspace. With so many opportunities for things to go wrong, businesses such as mine must take a proactive approach to avoid falling victim to an ever-increasing variety of threats. Recently, a virus infiltrated our system through a disk brought in by an employee. It worked it's way onto our database in no time at all, and the potential for serious restriction of our ability to maintain functional operational status was obvious. While we have administrative and IT security safeguards to protect us from things of this nature, our precautions were inadequate to avoid this particular problem. Luckily, we had instituted a disaster recovery plan some years earlier that allowed us to rid our databanks of the virus without any loss of data, even the data collected on the day in question. For me, this was an eye opening event. My previous thoughts on disaster recovery were limited to external events that might pose a potential risk. Despite all our efforts to the contrary, we were exposed and vulnerable. It wasn't the things that we worked on daily to maintain security that protected our company, but a plan of action conceived years earlier that had all but been forgotten. I now realize that there is so much more to disaster recovery than I previously thought. We were lucky in this instance, but now I can't help but think of what might have happened had we not been prepared.
42 What is price earnings ratio
42 What is price/earnings ratio The price/earning (P/E) ratio is another measurement that's of particular interest to investors in public businesses. The P/E ratio gives you an idea of how much you're paying in the current price for stock shares for each dollar of earning. Earnings prop up the market value of stock shares, not the book value of the stock shares that's reported in the balance sheet. The P/E ratio is a reality check on just how high the current market price is in relation to the underlying profit that the business is earning. Extraordinarily high P/E ratios are justified only when investors think that the company's earnings per share (EPS) has a lot of upside potential in the future. The P/E ratio is calculated dividing the current market price of the stock by the most recent trailing 12 months diluted EPS. Stock share prices bounce around day to day and are subject to big changes on short notice. The current P/E ratio should be compared with the average stock market P/E to gauge whether the business selling above or below the market average. P/E ratios are currently running high, despite a four-year slump in the stock market. P/E ratios vary from industry to industry and from year to year. One dollar of EPS may command only a $10 market value for a mature business in a no-growth industry, while a dollar of EPS in a dynamic business in a growth industry may have a $30 market value per dollar of earnings, or net income. To sum up, the price/earnings ratio, or P/E ratio is the current market price of a capital stock divided by its trailing 12 months' diluted earnings per share (EPS) or its basic earnings per share if the business does not report diluted EPS. A low P/E may signal an underbalued stock or a pessimistic forecast by investors. A high P/E may reveal an overvalued stock or might be based on an optimistic forecast by investors.
Career a self help guide
Could you hope to live without a career all life despite inheriting a legacy? Career is not just about living out of inherited money, nor is it limited to earning livelihood. Holistically speaking it is the progression of ones working or professional life. Career indeed means a lot these days. Nowadays, parents start grooming their children from the day one she starts her education, guide and help their children choose their career. Choosing and Making a Career To some, choosing a career is as simple as a ready to eat preparation served in a silver bowl, because their career is inherited through legacy. Still they don’t spare a stone unturned in their efforts to just pursue it and make successful careers. For example, Henry Ford, who is the third generation person to carry on the legacy of his parents successfully, has toiled hard to expand the empire beyond the Atlantic Ocean. Students should start thinking about their careers while in High School. Career exploring in various fields such as Accountancy, Finance, Law, Engineering and Medical, Business Management etc should be given a serious thought while they are still in College level. Well planning and choosing the appropriate line of study will definitely get you a good pick of your own choice. Career Counselors prove beneficial in personal development and if you need them to, they can double up as career coaches who guide you in choosing your career. They assess your scope of interest, ability, your personality and style of working and accordingly, help you choose your career. Career development Did you know choosing a career is much easier rather than developing it? Landing a suitable job may take less than a year but making a career is for the rest of your working life. Once you land up at your chosen career, you must try to manage it carefully by gaining deeper knowledge and skills, working ethically and with integrity, and climb the ladder of success, to achieve your goals by rising to a higher level or position in that organization. Slightest initial complacency would mean a longer stay at the same level for a long time, develop leadership qualities within and rise to higher level. Work conditions and ethics permit that you can have multiple careers to explore your capabilities. Be good at decision-making and this will be the step forward to boost your career. Never give up hope, as the saying goes `In every difficulty lies an opportunity’.
Low budget filmmakers must do everything required
So you say you have a burning desire to make a movie and you will do what ever it takes to get the job done? You fancy yourself and “independent” type and you want to reflect that in your art? Well, you better know what it takes before you decide to launch yourself into the world of independent filmmaking. If you do not know, your project may never see the light of day, or more importantly the light of a movie screen. Making a low budget or “independent” film is a double edged sword. On the one side you have the freedom to express your art without corporate considerations, but on the other side you have the daunting task of doing almost every job yourself. From writing, producing, directing, and acting to providing travel arrangements, applying make-up, and fixing broken equipment, you cover the broad spectrum of chores and responsibilities. And that does not even cover the other responsibilities such as providing meals for everyone, rehearsals, etc… All you have to do is look at the long list of credits at the end of any movie in the theaters and you can see how much work it takes to make a motion picture. While in the midst of making my last film Mike And The Magic Lamp I almost started to doubt whether I would ever finish it. I had been working on this movie for about two years straight doing every aspect of the film myself when I suddenly started to run out of energy. The continuous filming that I was doing combined with a heavy work schedule at my real job (Stage Manager of TV shows in Hollywood) was starting to get to me. I would have to prepare everything before a film shoot, and then do just about everything during the film shoots. Once in a while I would have a loyal friend help me with the awesome responsibilities of carrying equipment, setting it up, and then tearing everything down and putting it away each day, but you can only ask them to do so much if you are not paying them. At one point during the filming of M&TML I passed out, fell off my director’s chair and hit my head on the corner of the set. I was mentally and physically exhausted while only halfway through the filmmaking process. The problem was that I was not yet creatively exhausted. The burning desire to make a movie and enter it in all the major film festivals was still alive, but the vessel (my body) that allows me to create was in need of a little R&R. I would take a day off here and there but it was always hard to rest when you have that little creative voice in your head bugging you to get your film finished so the world can enjoy your art. I was very lucky that I only suffered a minor head injury from that accident. I finally finished the film Mike And The Magic Lamp after four long years of endless work that nearly put me in the hospital from exhaustion. The film went on to win the Silver Award at the Houston Worldfest in 1998 along with several other awards that year at major film festivals like the Santa Clarita International Film Festival. That film gave me recognition as an Independent Filmmaker and inspired me to pursue the path of making films on my own terms. I pushed myself to the limits mentally and physically to get my movies made in the beginning of my career and it was just the springboard that I needed to get launched into the world of independent filmmaking. I may have doubted my body’s ability to keep up with my creative drive, but I some how managed to strike an agreement between the two and get my films finished. Before you take on the daunting task of making a movie almost completely by yourself, you have to ask yourself one thing; AM I REALLY COMMITTED to this idea? If you are not, then I suggest you find another outlet for your creativity. If you are committed, then pursue it with everything you have inside, but make sure you realize that your creative drive cares nothing about your health. Copyright 2006. Michael P. Bringing up bright and happy children with autism
Ask any parent and they’ll tell you that parenting a child is the most difficult task they’ve ever encountered. They’ll also tell you it’s the most rewarding. Parenting a child with autism, however, can be a little more stressful. It can also be just as rewarding. The key to bringing up bright and happy children with Autism is to love and nurture them, as you would any child. Once your child has been diagnosed with autism, you may at first go through a typical sort of panic mode. One of the first things you may want to do is set up counseling for yourself to help you deal with any negative feelings you are having about your child. This can help you in this overwhelming time. You may also want to do some research on your own regarding Autism, as it will help you to understand what you may expect with your child. When you start researching, you’ll, of course, want to start with your child’s pediatrician. They can certainly help to point you in the right direction. There also may be support groups in your area and you’ll find that parents of children with autism can help you deal with this initial period, as well as being a great source for information. When you are choosing a program for your child with autism, you’ll want to seek the advice from professionals, such as your pediatrician and other autism professionals. Research the program to make sure it will deal with all aspects of autism, as well as make sure they are qualified to assist your child. Once you’ve come to terms with your child being diagnosed with autism, there are certain things you’ll need to take care of in the home. You want to bring your autistic child up in a home that is safe, as well as comfortable for your child. One of the first things you should do is a safety check. For example, if you worry because your child likes to sneak outside, you may want to install security locks on the doors. Make sure, however, the child can get out in case of an emergency. You may also want to consider fencing in the yard where your child can play safely. Some autistic children are very sensitive to touch and even bathing them becomes a struggle. You want your child to be clean however, you also want them to be happy. If this means foregoing a daily bath for one every other day, then by all means, do it. You can also help them to overcome their sensitivity to water by scheduling regular playtimes in water, such as playing with lawn sprinklers and squirt guns. You can make it a fun time and they may come to enjoy bathing. Most importantly, provide your child with activities at home, as well as outside the home. They may not want to participate in all of them, but it is important for your child to be treated as if they are included. Don’t leave your child home when going out for dinner. Take your autistic child with you and just make sure you go to a family type restaurant so if your child does misbehave in public, it is not such a big deal. Provide your child with an environment filled with different colors and textures. This will help to keep their attention on certain activities and if you provide them with the opportunity for social interaction, this can certainly help them in the long run. Most importantly, however, provide your child with love. Even if your autistic child does not like to be touched, there are other things you can do to let them know you love them. Talking with your child, even when you don’t feel they are listening is important to their development. Tell them how much you love them, whether they respond in turn or not. A child that is loved will feel this love, even if they have autism.
The russian bride and her uniqueness
: Your first letter So, you are creating your dating profile. It's very important to mention your REAL height, weight, marital status, your age, education and occupation; consider adding some photos to your profile. In your very first letter to the Russian bride you can write everything you think worth mentioning in the first letter to a stranger – this can be your life position, some aims and hopes, your interests, a description of person that your are looking for. Remember one thing – it not usual in Russia to call a woman 'dear', 'love', 'sweet' in the first letter. She may think you are insincere or too emotional. You should avoid official style, just be yourself. What things to discuss Never be afraid of expressing your feelings and thoughts: the Russian woman is naturally very sensitive and emotional. Ask questions and answer hers in return. Your questions might be like following: What kind of a man would you like to see near you? What is more important for you: family or business career? Ask how she spent last week and tell her what you did all this time. Write about everything you find interesting. Ask her advice on this or that matter or difficult situation in your life, share your plans for the future with her. It would logical to wonder about how long the acquaintance by correspondence should last. In this matter you should retain the sense of proportion. On the one hand, long correspondence makes an opportunity to know each other better. On the other hand, Russian women don't like inert men and will find long correspondence a great nuisance. Therefore you have to pick the crucial moment of transition to personal meeting intuitively. Then you should decide where your first date will take place - in her country, in your country or in any other country. On the one hand, it's more comfortable for you to have a meeting in your country – you'll feel yourself a master of the situation but for your beloved one it can be difficult to be in the unknown place and and that can embarrass her. Meeting in her country may seem like a better idea – she is at home and this fact will help her to be herself while your meetings. But the more fair variant is to meet in any other country – there both of you are in the same conditions. Russian bride and her Love Due to the reality of the Russian life (the wars and totalitarian regime) the awareness of the of the submissive role of women and to the fact the number of women in the country has always been considerably larger than that of men; this definitely can be the reason for this self-sacrifice and artificially lowered requirements. Since then the demographic situation didn't changed. In their love Russian women often trust their hearts, not logical thinking. One may be a tall, handsome and wealthy fellow and still fail to attract a Russian woman's attention; the other one may be crazy about her and still fail to arouse a response in her. It does not mean she needs a man with physical or spiritual shortcomings. The thing is that she must fall in love with You and Only You and then you may count on all-conquering forgiveness and on absolute devotion. Usually Russian woman does not expect to profit by her love, she is genuinely selfless, and she often sacrifices her career and her interests because of her family interests and needs. Devotion determines to a great extent the behavior of a Russian bride in love. For most Russian women the words of the church wedding rite 'I vow to stay with my husband in grief and joy until death separates us', are still the matter of current significance. Russian lady and her husband A married Russian woman has her life values arranged like this: children - husband - relatives - her home - her job. As you can see, husband plays one of the predominant roles in her life. Always he is a regular sexual partner. A Russian women nowadays, especially those over 25-30 years old, has certain problems with finding a man to establish permanent sexual relations with. So, the husband is everything to her. This is also proved by the fact that after the wedding the number of female friends of a young wife is considerably reduced: she doesn't need them any more because her husband also becomes her best friend. The husband has traditionally been the highest authority for the Russian woman. She will not go out, nor make major purchases, does not take any important decisions without first consulting with him. For Russian women, children have always been the highest value. If you already have your own children Russian lady will surely love them too, as if they were her own ones, because the beloved man and his offsprings are inseparable for her.
The possible doomsday consequences of antibiotic resistance
For a period of time in recent history, antibiotics were heralded as being the most effective possible treatment for infectious diseases. Most of those illnesses were caused by bacterial agents, so the use of medications that killed off harmful bacteria was a sensible, practical solution. However, there is no clear indication that anyone within the medical or scientific communities saw the rapid evolution of antibiotic resistance coming. Even if someone did, history certainly doesn't reflect it all that well. Regardless of the slip-up of the past, it is now understood that the typical antibiotic has a limited lifespan now, being rendered nearly useless as soon as the bacterial agent they target has developed resistance to their effects. This was the case with tuberculosis, which was once thought to have been wiped out in the developed world, and is the case with many other bacterial infections. The problem of dealing with antibiotic resistance is a complex one. Some bacterial agents have developed their resistance only to certain agents – though those agents are the ones that are prescribed as treatment. Other microbes, on the other hand, have developed effective antibiotic resistance to all antimicrobial agents currently available on the market. This situation, some public health officials worry, is bound to cause major problems. A number of experts are pointing out the gradual increase in the number of resistant cases of tuberculosis to be an indication of the possible damage this problem can cause. With tuberculosis being resistant to all the current drugs used against it, treatment for patients with the resistant strain is becoming more and more difficult, and the disease is becoming more and more fatal. One single illness that has antibiotic resistance does not a major public health problem make. Most authorities in the medical field would not be worried if there wasn't evidence that other bacterial infections are starting to prove as resilient as the common cold. The common cold has long been a problem for medicine, such that being able to develop a cure for it has long been considered impossible. The bacteria at the root of the cold adapts with a rapid pace, becoming resistant to the effects of medication used to treat it the year before. While hardly something that is life-threatening, there is a very strong possibility that other, more dangerous bacterial agents might emerge with the same level of adaptability. Another possible scenario involves multiple bacterial agents developing resistance and reemerging into the public arena. Their infectious nature and antibiotic resistance, plus the relative degree of congestion in the average urban area, nearly guarantees a rapid spread of infection. If this sounds like a bad plot for a doomsday scenario in a science fiction novel, that's because said scenarios may not really be that far off the mark. Bacterial adaptation against countermeasures being used against them is at a much faster rate than how fast researchers can develop new antibiotic medication. For example, a hospital in Switzerland found that, within a period of three years, the strains of Escherichia coli that they encountered developed resistance to all five known types of antibacterial agents for it. They have also noted that this sudden increase in resistance was linked to the increased use of said antimicrobial agents, which has caused some to believe that the very success and widespread use of antibiotics is the root cause of the problem. The more bacteria are exposed to the medication, the higher the chances that a mutated strain will emerge that is resistant to the effects.

Landlord s corner apartment lease agreement late fees in ohio
A. Limits As To Amounts There are two lines of cases in Ohio which deal with whether courts will enforce lease provisions allowing a landlord to charge tenants for late fees. These lines of cases come to slightly different conclusions, but the bottom line is that landlords need to be very careful in charging tenants for late fees. The first line of cases comes to us from the Eighth Appellate District. In the case of Siara Management v. Nedley, 1992 Ohio App. LEXIS 5265 (Oct. 15, 1992) Cuyahoga App. No. 61433, unreported, the lease called for the tenant to pay $30.00 in late fees if he was late five days, and $70.00 more if he were late ten days. The landlord tried to charge these amounts to the tenant and litigation ensued. The Eighth Appellate District held that there is distinction between liquidated damages (allowable) and penalty clauses (not allowable) and that the court would use a three part test to distinguish between the two. Late fees would be allowable as liquidated damages if they were designed to compensate the landlord for damages which were: (1) uncertain as to amount and difficult of proof, (2) the contract as a whole is not so manifestly unconscionable, unreasonable, and disproportionate in amount as to justify the conclusion that it does not express the true intention of the parties, and if (3) the contract is consistent with the conclusion that it was the intention of the parties that damages in the amount stated should follow the breach thereof. In Nedley, the landlord did not make it past the first hurdle of the test. All that the landlord argued in court was that the late payment by tenants led to late payment charges assessed to the landlord by his creditors. The Court reasoned that "Any party due money could claim that the resultant decrease in cash flow might result in late charges against it. That is unduly speculative." Had the landlord come to the court with evidence that the tenant's late payment had caused him to incur damages in specific amounts, then those specific amounts might have been recoverable. The Eighth District Court of Appeals also came to a similar conclusion in 200 W. Apartments v. Foreman, 1994 Ohio App. LEXIS 4081 (September 15, 1994), Cuyahoga Co. App. No. 66107 regarding a late fee of only $2.00 per day. In that case the court also found it significant that the landlord had shown no proof of its actual damages. However, another of Ohio's appellate district treated the matter very differently. In the case of Calabria v. Green, 1995 Ohio App. LEXIS 3903 (September 8, 1995), Trumbull Co. App. No. 95-T-5181, the Eleventh Appellate District Court held that while late charges of $10.00 per day (for 38 days) was not enforceable, "an agreed upon, one-time late fee, that is reasonable in proportion to the rental rate, and that has a rationale basis supporting the imposition of the charge, is proper." The Eleventh District Court of Appeals again came to the same conclusion in the case of Wadsworth v. Starcher, 1998 Ohio App. LEXIS 2909 (June 26, 1998) Trumbull Co. App. No. 97-A-0054. In Wadsworth, the Court agreed with the trial court that $5.00 per day in late charges over 92 days was not enforceable, and that the trial court's reduction of the late fees to $100.00 was proper. It is clear that "parties to a lease agreement can agree to anything they wish within the limits of the law." Village Station Assoc. v. Geauga Co. (1992), 84 Ohio App.3d 448 at 451. The real question is: what are "the limits of the law"? R. C. 5321.14 prohibits parties to a lease from agreeing on illegal or unconscionable terms. B. No Late Fees Under Oral Contracts Where there is only an oral contract between the landlord and the tenant, at least one Ohio Court has held that no late fees can be assessed. Neubauer v. Patzkowsky, 1992 Ohio App. LEXIS 2919 (June 2, 1992) Franklin Co. App. No. 91AP-1236. C. Waiver of Late Fees Some landlords will try to collect late fees which have piled up over months and months. In the case of Habegger v. Paul, 2004 Ohio App. LEXIS 1971 (April 30, 2004) Wood Co. App. No. WD-03-038, a landlord sued the tenant for late fees which accumulated over a 14 month period. The Sixth District Court of Appeals held that the landlord waived his right to collect the late fees upon eviction by continuing to accept the tenants' rent payments and not pursuing eviction until approximately 14 months after the first late payment. The Court reasoned that: A party may voluntarily relinquish a known right through words or by conduct. State ex rel. Ford v. Cleveland Bd. Of Edn. (1943), 141 Ohio St. 124. In Galaxy Development Ltd. Partnership v. Quadax, Inc., 2000 Ohio App. LEXIS 4651 (October 5, 2000) Cuyahoga Co. App. No. 76769, the Eighth District Court of Appeals found that the landlord waived its right to collect holdover rent from the tenant by continuing to accept the original rental payments after expiration of the lease. The Galaxy court cited Finkbeiner v. Lutz (1975), 44 Ohio App.2d 223, wherein lessees failed to make timely payments of rent on numerous occasions and lessors accepted the late payments. The Finkbeiner court held that the failure of the lessors to make timely objection to the late payment of rent amounted to a waiver. Courts in Ohio will not allow a landlord to collect late fees which have piled up over a significant period of time. D. Dangers for the Landlord Where a landlord can get into trouble with late fees is in a dispute over a security deposit. Let's say the landlord has collected a security deposit in the amount of $500.00. The tenant leaves at the end of the lease term. The landlord finds $300.00 in damages at the apartment and also assesses $250.00 in late fees. Perhaps the landlord cannot show the court actual damages in the specific amount of $250.00. Maybe there was only an oral agreement between the landlord or the tenant. Perhaps the $250.00 in fees resulted from the landlord's practice of letting the late fees pile up over time. If any of these are the case, there is a good chance that even in the more landlord sympathetic appellate districts, the landlord will only be allowed to charge the tenant a greatly reduced amount if the facts fit the first example, and perhaps nothing at all if the facts fit the second or third examples. This will leave $100.00 or more that should have been returned to the tenant, entitling the tenant to double damages and attorneys fees under Ohio Revised Code Section 5321.16. While double damages in the amount of $200.00 might not be all that big of a deal, wait until you get to the mandatory hearing on reasonable attorneys fees. Now we're talking real money. If you are trying to evict a problem tenant and your only basis is a failure to pay late fees, then the arguments above may have a bearing upon the issue of who has the right to possession when you get to the F. E.D. hearing. If a tenant can show the court that he stood ready at all times to pay the late fees, but that the landlord was holding out for an unreasonable amount, or if the tenant can show that he and the landlord engaged in a pattern of conduct of acceptance of late payments without protest, this could defeat the eviction action. E. Lessons to Be Learned One of the lessons to be learned from all of this is that late fees are something of a minefield when it comes to using them to reduce the amount of the security deposit returned to a tenant. The same is true when we are talking about evictions based upon a failure of the tenant to pay late fees. Landlords should be aware of the problems that may arise when late fees are argued. Informing your attorney of your past practices with regard to late fees can save you both a lot of embarrassment, and perhaps allow the attorney to alter course in his arguments to get around potential hurdles.
Exciting things to do in mauritius
If sitting on a beach all day every day isn’t quite your cup of tea, but you really fancy a long haul holiday to a stunning island destination, Mauritius could be just what you are looking for. With many activities both in and out of the resorts, a luxury holiday in Mauritius can provide interest for a range of visitors. The island itself is an independent state in the Indian Ocean, 900km east of Madagascar. The area is 1860sq km and is made up of a central plateau, gradually rising towards the South West where it reaches it’s highest point at 800m. Excursions around the island will give you an insight into the islands rich and colourful history, and where better to start than the vibrant capital, Port Louis. The harbour on the west of the island lies sheltered in a semi-circle of mountains, and the town has plenty of character, and proudly displays signs of it's historical past. There is a new waterfront development which is home to many shops. This is complimented by the old market a stone's throw away. If designer shopping outlets is what you are looking for, then a trip to Curepipe is well worth the visit. This is the islands main urban centre, and is worth a stop if travelling through it on route to somewhere else! It’s located in the centre of the island between Port Louis and the airport. Mahebourg is a village which is worth a visit, especially if staying in the south east of the island. It’s still one of the islands main fishing villages, and you are at leisure to wonder round the market stalls. If you are staying at the Shandrani, you can even hire a bicycle and cycle there! Catamaran Trips can be arranged from most hotels and are an excellent way to see the beauty of Mauritius from the relaxing waters off the Indian Ocean. These are normally full day trips, where a bar-b-que lunch is provided of freshly caught fish, and salads. You are encouraged to snorkel from the boat, and you also have time to relax on one of the beautiful beaches of the island. Just watch out for the rum cocktails on your way back to the hotel! Mauritius has a wealth of activities orientated around it’s environment. A nature park close to Port Louis, Domaine les Pailles, covers 3000 acres at the foot of a mountain range. There are deer and rare birds in the park, and if you like a bit of adrenaline, Land Rover ‘safaris’ and quad biking are also available. The island has a stunning botanical garden called Pamplemousses, it’s known to naturalists throughout the world for it’s large collection of indigenous and exotic palms, and the giant Victoria Amazonica water lilies. It is well worth paying for a guide to take you around the gardens as their knowledge and tit-bits of information make the visit all the more enjoyable. A unique feature in Mauritius is Chamarel, an area of undulating land stretching in contrasting layers of colour, an patches of blue, green, red and yellow earth, all believed to be the results of weathering. Mauritius is well known to ornithologists and the Casela Bird Park is set in the area of Black River, and stretches over 20 acres. There are more than 140 varieties of birds, from 5 continents. The main attraction is the Mauritian Pink Pigeon, one of the rarest birds in the world. The beautiful flower of Ylang Ylang with it’s fragrant yellow flowers, is grown in a plantation called Le Domaine de l’Ylang Ylang. Here the perfume is distilled over panoramic views over the bay of Vieux Grand Port, where the neighbouring islets can be seen. Trips around the island can be booked from your hotel, with luxury holidays in Mauritius to a variety of hotels including the Shandrani can be arranged through Beachcomber Tours. Review of hp toshiba and dell computers
Whenever you are in the market for any common consumer good, you find your self inundated with advertising slogans and marketing messages. So, how do you find out what is best for you? Take the case of computers. With the high rate of obsolescence in computer hardware, you will find yourself in the marketplace for computers quite often. And then it all begins: You are bombarded with technical specifications as well as emotional appeals. Each manufacturer tries to tell you why they are the best. So that you can make an intelligent decision, I have decided to review three computers for you. For this review, I am considering the Dell Latitude C600 Laptop, the Toshiba Satellite A135-S4527, and the HP Pavilion Media Center M8120N Desktop PC. Note this is not a comparison of the three computers; rather it is like a review of three different computers. The Dell Latitude C600 Laptop has the 850 MHz Pentium III processor, a 14.1" display, 256MB of memory, and a 10G hard drive. It serves the needs of most users. But, customers have reported that it heats up more than the usual laptop. Another shortcoming that some consumers have reported is about the fact that this machine has only 1 USB port. The Toshiba Satellite A135-S4527 has Intel's 1.73 GHz Core Duo T2080 processor. This processor has a multithreaded architecture for improved multitasking performance. It has a 120 GB hard drive and 1 GB of installed RAM. Most uses find the machine to be great value for money. In fact, it has been occasionally labeled the College Students Computer due to its affordability. The HP Pavilion Media Center M8120N Desktop PC, unlike the previous two is not a laptop. It has the 2.4 GHz Intel Core 2 Quad E6420 quad-core processor. This processor is really fast when it comes to multitasking applications. This machine has 2 GB of installed RAM up to 8 channels of surround sound output, and Wi-Fi connectivity. So, when you are in the market for a computer, make sure to compare all the features between similar models and only then make your final choice. In doing so, do not forget to consider the price of the different options. Sometimes a missing feature can be added on later. And then again, you cannot forget the all important after-sales service. There are many horror stories that one hears about service. Make sure to read around before you decide on one computer.
Viruses
Viruses What They Are And One Reason Why People Make Them Over recent years, computers have become synonymous with viruses and viruses don't show any signs of disappearing any time soon. In recent news, LiveScience reported that "Before the month is even done, April has set a record for virus e-mails."1 In the past, we would be comfortable in telling new computer users not to worry about viruses and that catching a computer virus is rare. Today, that would be some of the worst advice we could give anyone. As reported in countless news reports, computer viruses are rampant and they're extremely worrisome. This article will describe what viruses are and then point you in the direction of some rather unique protection and prevention. In short, a computer virus is a software program designed to destroy or steal data. It attacks computers via distribution - often unknowingly - through email attachments, software downloads, and even some types of advanced web scripting. Viruses that destroy data are known as Trojan horses, viruses that explode their attacks are called bombs, and viruses that duplicate themselves are called worms. Some viruses are a combination of each, however they can be further identified according to where they're located on a computer. A virus originating from the boot sector of a computer is a boot-sector virus and this nasty devil does its dirty work the moment a computer is turned on. A virus that attaches itself to (infects) other programs is a file virus and activates the moment that an infected program starts. File viruses may also be referred to as parasitic viruses, however should a virus work from both the boot-sector and from an infected program, the virus is then known as a multipartite virus. Why viruses exist remains a mystery, however we had privy access to the mind behind a virus programmer who explained his motivation behind his destructive inclinations. Apparently, this person had a deep grudge against a popular online service which shall remain unnamed. In this hacker's mind, the online service failed to do a quality job in protecting children from online smut and as retaliation, he created and distributed a virus to as many file libraries of this service as he could. His intentions were to disable the computers of the online service's users so much that they wouldn't be able to connect for days. In his mind, the loss of connection meant loss of revenue for the online service. Although the malicious code that this person generated may have worked for a small percentage of users, sufficed to say, the online service continued on and still exists today. Despite his motivation or intention, his efforts were null. We wouldn't be surprised to learn if other motivations behind spreading viruses were similar to this person's, but that doesn't justify the damage that viruses do. Innocent people become pawns for the evil plans of others who've convinced themselves they're doing the "right" thing. To protect a computer from getting a virus, or clean a virus from a computer system once infected requires the use of an antivirus utility. But may be something else we can do. Perhaps we could make an effort to educate the people who want put viruses into the public about ways to display dissatisfaction with a service or product that don't involve harming innocent parties. In doing so, we just might reduce the number of virus news stories and protect our own investments at the same time. Finding a cheap motorcycle helmet
A cheap motorcycle helmet doesn’t have to be inferior to the more expensive ones. It is just a matter of looking for what kind of motorcycle helmets would work best for you. There are cheap motorcycle helmets that can perform just as well as the most popular brands out there. In order to look for them, you should be able to know how to find those helmets and what features and qualities to look for. One of the most important features that you should look for in looking for a cheap motorcycle helmet is the comfort that it provides. The motorcycle helmet can either make or break your riding experience. An uncomfortable helmet can make any ride an agonizing experience. Helmet comfort is difficult to determine right away. In order to make your search easier, try checking out cheap but recognizable brands which are generally the most comfortable. Check out also the soft rubber padding touching your head as well as the solid seal around the ears. Check out also the neck roll which cradles the back of your head and neck. When trying out a cheap motorcycle helmet, make sure that it snugly fits into your head without being too constricting. But also make sure that it isn’t loose enough to shift about your head. Another feature that you should look for in a cheap motorcycle helmet is the level of safety that it can provide. The best motorcycle helmets are those that provide the most protection. In finding the best helmet for you, check for the fit as well as the interior padding that can provide you with the protection that you need. See to it that these interior pads can help provide the amount of safety and protection that you are looking for as well as comfort. Try also checking out the helmets chin strap which must reach around your and under your chin comfortably and securely so that the helmet would not shift about unnecessarily. Make sure that your helmet is also the best fitted for you by wearing it yourself. A good fit should mean a helmet that is settled low on the forehead and just above your eyebrows. Check yourself in the mirror while wearing the helmet to make sure that it is straight and properly fitted. For safety purposes, be sure to choose a DOT (Department of Transportation) approved helmet to be sure that your safety and protection is guaranteed. Try checking the safety ratings of the helmets that you are checking to ensure that you will be using a helmet with reliable head coverage.
Stepping stones ladders and bridges
Start small work your way up. Take care of the little things and the big things will take care of themselves. Climb the ladder one rung at a time. Get your foot in the door and the rest will follow. Well worn platitudes all. But what does it have to do with writing? Many writers think that the secret to getting published by a major house is working their way up. Write a book, get it published by a vanity/utility publisher and that’s the first rung on the ladder to success. But is it? Do these books count for anything other than massaging the ego of the writer that they are indeed now ‘published’? No. The publishing industry doesn’t consider a vanity book as a writing credit because it hasn’t been vetted. No one has determined that the book is well written or has market value. Quite a few agents and publishers look down on a writer that includes a vanity book in their resume as being unprofessional and naпve. Some even consider it a disadvantage because they assume the writer couldn’t get the book published or they would have. A vanity book indicates to them poor writing. What about the motivation that is sparked by holding your very own book in your very own hands? Well odds are your hands will be the only ones holding that book. The average number of copies a vanity published book sells is about 100. Most literary agents are unimpressed until the sales level reaches 5000 or so copies. And those copies have to verified, the author can’t just go on a credit card spending spree and buy tons of their own book. It’s not really a fair assessment because it is next to impossible to get a vanity book stocked in a bookstore. Bookstores are where most books meant for the public are sold. The stores demand 90 day payment terms and most vanity books are publish on demand which means paid for when ordered. Most publish on demand books are not returnable and bookstores want to return unsold copies. Publish on demand books are priced from 30% to 50% higher than an offset printed book. Bookstores want competitively priced books. And finally publish on demand houses don’t offer discounts that allow enough profit margin for the stores. Vanity published books are appropriate in lots of circumstances. The author has a book that appeals to a niche market that is too narrow for even a small press. The author lectures and speaks and wants a book that can be sold in the back of the house. The author has a book that is meaningful to their family or other personal relationship group but doesn’t have much appeal outside that group. However much writers would like to believe it, a vanity published book is not a step up the ladder to a writing career, or a stepping stone to greater publishing achievements.
Personalized baby shower gift ideas
: Personalizing a baby’s gift is an excellent idea, making the gift distinct and special and grows into a cherished token through the years. When giving or making a gift sooner, before the baby’s due, you are faced with a problem, that is, you are not yet certain of the name and the birth date. An option to consider is by giving a gift certificate for an etching or engraving design along with your gift. This way, when the wonderful day arrives, the parents can take your gift and have it personalized. Choices for personalized gifts are baby cups, picture frame, jewelry or a cutlery set. There are wide selections of items that can be personalized; all you have to do is look. A blanket for baby embroidered with the baby’s name alongside the name’s meaning would make an excellent gift for both mom and baby. Your labor of love gift basket Gift baskets are very popular today and indeed a wonderful idea which can either be purchased made-to-order or ready-made. Or, you can do it yourself by putting together all baby items that you like for the baby. Here’s how you can make one: 1. Know first the size of the basket that you will use. A very large basket may be difficult to fill, so a medium sized is recommended. Usually, craft stores sell baskets of different sizes, shapes and colors. Shredded tissue paper and raffia make great fillers to be layered at the basket’s bottom, alongside with baby towels and blankets. 2. If you do have a large basket, you can easily fill it up by choosing bigger items as well, such as crib comforters, stuffed bunny or teddy, pillows or crib bumpers. 3. Take into consideration the baby’s gender, what really the baby needs. For a first baby, there will be many things that he will need. Having to look at a baby registry if the mom to be has one, can help a lot, since you will know what the baby really needs. If there is none, you could always ask the mom what else she needs for the baby. 4. Consider having a theme. You can load the basket with everything pink for a baby girl or everything blue for a baby boy, or everything having a “pooh” or a dinosaur design. A bedtime theme basket filled with story books, music CD, blankets, pillows, pajama, musical crib mobile and a teddy bear can be a wonderful idea. Be creative and let your imagination soar. 5. Another way of being creative is instead of using a basket, a baby tub, a diaper bag, a small laundry basket or a trunk can also be used. 6. For a tub, you can fill it with baby bathing accessories, such as soaps, towels, bubble bath, powder, baby shampoo, lotion and bath rubber toys. 7. For the trunk, you can fill it with baby’s keepsake book, monogrammed items, receiving blankets, heirloom items, a picture frame and an inspirational book all about mom and baby. You can also place a little inspirational note containing all your wishes for the baby. This will add a more personal touch to your gift. 8. For the laundry basket, you can fill it with cute slippers, diapers, baby comb and brush, booties, and baby clothes. For More Info on Baby Shower Tips, Visit Baby Shower Planning
What would save you time
We all get overwhelmed from time to time, and sometimes it seems as if 24 hours a day is just not enough to get everything accomplished that we would like. Let's consider this a brainstorming session. Start creating a list of everyday tasks that, if you didn't have to do them, would allow you to have more time in your day. For example, most of us have to do laundry on a regular basis. That takes time. What about making dinner? Commuting? The list goes on. These types of tasks are usually necessary and unavoidable. It would be fantastic if we could hire a housekeeper, a personal chef or a chauffeur to handle these things for us. More often than not however, we end up doing ourselves the things that need to be taken care of each day. Now try thinking of other things that take up your time. Maybe you are a small business owner who just doesn't have time to handle the bookkeeping portion of your business, or to deal with the email traffic coming into your Inbox. What about organizing your files (both hard copy and electronic) so that it becomes easier to find what you are looking for? In most cases, organizing your time better is all it takes to resolve these types of time management issues. Try reading your email only two or three times a day at specific times, instead of each time a new message arrives (although the curiosity factor might be quite strong!). Schedule your housekeeping items all at once on the same day, if possible. For example, do all of your laundry on Saturday mornings. Try planning your meals ahead of time, so you know exactly how long it will take you to prepare and cook each meal. For the office tasks, spending some time with a professional organizer or partnering with a virtual assistant can save you hours of time. Plus, it would allow you to hand over tasks you do not enjoy doing to someone who makes a living doing those very things. Food for thought! The main point I'm trying to make is that with a little thought and planning, you can create extra time in your life to do the things you love to do. Good luck, and happy planning!
Social bookmarking word of mouth and seo marketing on steroids
Social bookmarking has finally got a foothold. Social bookmarking is being seen by many marketing experts as a cost effective method of augmenting distribution of content, branding and image building and marketing. According to a survey, it has been seen that almost 28% of users on the Internet on a normal day have been tagging online content while 7% of users on the Internet have been either tagging or categorizing content. This method is being seen as a highly successful idea and this can be seen with the amount of success achieved by Del. icio. us. Del. icio. us had acquired their first million visitors in 3 years but they acquired the next 2 million visitors within a span of 6 months. So what is social bookmarking? Social bookmarking can be compared to linking. Social bookmarks are basically links that help an internet user to classify, share, store and even search for content using a process called tagging. Tags just make it easier for internet users to find the content they are looking for. You can apply social bookmarks to content or information in different formats like PDF, video, blogs, websites, images etc. Some of the top social bookmarking websites include StumbleUpon, del. icio. us, Google Bookmarks and Furl. Reddit and Dig are two social news websites, which are also considered as social bookmarking sites. The idea is to create positive content about your services, products or overall business and then optimizing the content on these social bookmarking websites. Social bookmarking is an interesting concept that can be used for enhancing the process of marketing and promotions. What marketers can really do is allow sharing of content by the visitors. As a result, the bookmarks encourage a kind of functionality that is most often referred to as forward-to-a-friend process. Apart from this, marketers can also post their own content on different social bookmarking websites, which will initiate movement of traffic to their sites. In a sense, this is an online version word of mouth advertising where surfers share their bookmarks. But for social bookmarking to be a real success, you need to have engaging or interactive content, which users will find useful, interesting and entertaining. It should be the kind of content that most users can recommend to others or forward it. The content should attract users and this is where creativity plays an important role. You will have to look from the perspective of an internet user to gauge what he or she might be looking for and then provide it. There are certain tips you can follow to make social bookmarking a marketing success for your online business and they are: Understand the requirement of your audience and try to focus on topics that will interest your readers, audience or users. Content should be interesting and yet easy to read. The more heavy words and sentences you use, the more difficult and unfriendly it will be for the reader. Look at the blogs – most blogs have reader friendly and more personalized content. Apart from this, you can also add bold and colored or highlighted fonts to assist in increasing readability. The title should be interesting and hint at what the article is all about. If you want to provide information only on Pay-per-click then there is no point having a title like “The best internet marketing tools.” Readers will think that this article encompasses all the methods and it will be useless for a reader who wants specialized information about Pay-per-click. On the other hand if you have a title like “Less money, more traffic using Pay-per-click” This title will attract the attention of readers looking for specialized information on Pay-per-click and other readers who want information on internet marketing methods. Keywords are extremely important in bringing traffic to your website. Use of keywords is a key factor that drives search engine optimization. If you don’t use the required amount of keywords then internet users or readers might not be able to find your article using the Google or Yahoo search engines. Using a content format that will ensure readability is important. If the size of your font is too small then it might be difficult for most of the readers to appreciate the content however important the information provided by you may be. If you want users to tag your content then it is important that you place buttons at the top or the bottom of your article. You can also avoid clutter by including bookmark option of only those social bookmarking communities that are best linked to your business. These are some of the ways by which, you can use social bookmarking to your advantage.

Aspen nightlife the ultimate taxi 404
Aspen Nightlife – The Ultimate Taxi This isn’t your ordinary taxi ride! The Ultimate Taxi is actually entertainment that is not to be missed. This is a thirty to forty minute musical ride around Aspen – but it’s not like any other ride you will take in your lifetime. The taxi you will be riding in is a 1978 Checker cab. It has been greatly modified and boasts four red lasers, a laser projector, black light effects, light washers, light orbs, mini-strobes, color changing fiber optics, a sound system, stage lights, a mirror ball, a fog machine, a keyboard, digital drums, a digital camera, a DV cam, a notebook computer, a printer, and much, much more. Your driver will be Jon Barnes, and he has been driving tourists around Aspen since 1984. He throws in a pair of 3-D glasses, so you can view Aspen as you never have before. Featured online, in radio interviews, magazines, and newspapers, the Ultimate Taxi has become very popular. Many famous people have taken this cab ride as well, including Clint Eastwood and Jerry Seinfeld. Get ready for a wild ride! Jon plays the keyboard and the horn while driving! With your 3-D glasses and the other toys that are included in the ride, combined with the psychedelic lighting effects, this is one ride that you will never forget! In fact, Jon makes sure of it, because there will be pictures to help you remember the event. Make sure you buy some souvenirs before you leave. The Ultimate Taxi gift store is located right outside the doors, in the trunk. You will also have a web page memory of your ride in the Ultimate Taxi hosted on Jon’s server for all time. Take your toys and 3-D glasses home with you as well. The Ultimate Taxi is not a ‘normal’ taxi ride. You don’t call Jon Barnes to take you where you want to go. The Ultimate Taxi is more of a musical show and adventure. It has been called the world’s smallest recording studio. Make sure that you get your Ultimate Taxi ride while you are in Aspen, and join the ranks of Ivana, Kevin Costner, George Hamilton, Jerry Jeff Walker, Dudley Moore, the Beatles, Clint Eastwood, Jerry Seinfeld, and even Regis Philbin! Due to the popularity of the Ultimate Taxi, it is probably best to call in advance for a reservation. The Ultimate Taxi is in operation from 7pm to 10pm most nights. (word count 404)
Say goodbye to your future babies
People have a preset idea about how many children they would like to have in their families. Some put into consideration how much they can actually support, and some think about how many children they can conveniently take care of. But what happens once they've reached the number of children they want? Enter contraceptives. Birth control plays a big part for couples who would still like to enjoy an active sex life and not worry about bringing forth an unplanned child. There are different temporary and permanent birth control methods to choose from. However, it is important that you think things through very thoroughly before deciding on a specific contraceptive method to use. You may, after all, regret your decision if you've made a bad choice. Temporary birth control measures come in a variety of packages: pills, injectables, condoms, creams, gels, caps, and intra-uterine devices (IUDs). Contraceptive pills and birth control shots are part of the hormonal birth control method that aims to change a woman's hormone level to make the uterine environment non-conducive to fertilization and implantation. Condoms, cervical caps, spermicidal gels and creams compose the barrier method that aim to stop or block sperm from reaching a healthy egg cell. It can either collect the sperm in a certain container, or altogether kills the sperm cells. IUDs work by creating a localized inflammation in the uterus. Because of this inflammation, the body's auto-immune system will send white blood cells to combat the inflammation, and in turn kill sperm cells near the area. The favorable point for temporary contraceptive measures is that it is fully reversible. When you are ready to get pregnant, all you need to do is stop taking or using the product and give the body time to get back to its condition prior to using the contraceptive. Permanent birth control, also called sterilization, involves a surgical procedure of tying the tubes that channel the sperm and the eggs cells. Sterilization surgeries are different for men and women, these operations include: l For women: Ѓ Tubal ligation. This procedure blocks a woman's fallopian tubes. After having the tubes tied down, the egg cell cannot move from the ovary to the uterus. Just the same, the sperm cells cannot reach the egg in the fallopian tube after it has been released by the ovary because their passage is blocked as well. This procedure may be reversible, though the operation will be more complicated that tying the tubes. There are not guarantee of successful reversal of the effects of tubal ligation. Ѓ Hysterectomy. This is a surgical operation wherein the uterus is removed. It may be partial or complete. Some doctors also remove the ovaries and the fallopian tubes along with this surgery. l For men: Ѓ Vasectomy. This is a surgical operation wherein a man's vas deferens is cut or clipped to prevent healthy sperm cells from joining the semenal fluid during ejaculation. After vasectomy, sperm cells do not exit the body through the penis. They are broken down into smaller particles and absorbed back into the bloodstream. It does not affect a man's libido, and like tubal ligation, it may be reversible, but there are not guarantee of success. Choosing the best birth control measure will depend on you. Other people may give you helpful tips and suggestions, but look for the one that works for you. Give yourself to think the decision over and then choose whether you'd like to go with temporary or permanent birth control methods.
Look before you take the leap into pre paid legal services 452
Look before you take the leap into pre-paid legal services Choosing a pre-paid legal plan is a good way to save big bucks, but choosing a plan you need and a provider you can trust is a different matter. Here is a number of things to look for in a legal plan from the very start: Look for what’s covered: Legal plans are offered in different models and differ in the specifics of what they cover. While phone consultation and simple drafting and reviewing of simple contracts are included across the board, more elaborate and complicated legal matters are not covered. It’s best to review your own legal needs before you choose a legal plan. Ask which legal services will you need most and then choose a plan that provides the best coverage given those needs. For instance, if you are a business owner, lawsuits, lease and contract negotiations could be high on your list and you would be looking for a legal plan that provides coverage accordingly. Know what legal coverage you already have Don’t pay for coverage twice! If you have car insurance, then you are covered for liability and medical protection, home insurance covers you for injuries sustained on your property… Your existing insurance policies already cover some of your legal costs and there is no need to pay for that coverage when you select with a legal plan. Does the company have an in-house procedure to handle complaints? One of the stumbling blocks of pre-paid legal services is quality of service. Newly-licensed attorneys, phone calls not getting answered and that ointment on any client – lawyer relationship: fee disputes, typically involving bills made to your credit car to cover for services not included in your contract… This is just a specimen of the many problems people face with their plan providers. Make sure you select a plan that has clear guidelines as to how to settle dispute when they arise. A company that has a good in-house mechanism to handle complaints will generally assign a senior attorney with the authority to handle customer complaints of and disputes with any attorneys in the network. Secondary sources of resolution may include your state insurance department or bar association. Check their outlet for complaints against pre-paid services. Checking out the business you’ll need to do some homework before you select your legal provider. Ask these questions: What’s the firm’s reputation in my area? How many years have they been in business? Have they been operating in my local area for at least a year without complaints? How skilled are they attorneys? Do they cover the locale where my business operates? Some good places to start your background research are your state bar association, the Better Business Bureau and the Consumer Affairs Office. Good grades are nice but mastery is better
When I was growing up, there was nothing better than bringing home a report card that had good grades on it. Oh, I wasn’t a straight A student, but I got my share of A’s and B’s. I also got my share of C’s and D’s. I guess I was what you call an average student. My parents always checked my report card and questioned any low grades and encouraged me to do better when they felt that I wasn’t working up to my abilities. Today good grades are still the benchmark we use to determine if a student is going to be promoted or retained. The higher achieving students who are in high school usually strive for good grades in rigorous courses, because they know that their class ranking among other things will determine the type of college that they will be admitted to. Good grades are something that everyone wants, and for some reason, they’re just about what everyone gets. The two questions that I have are these: does everyone who gets a good grade deserve it, and is that grade a good indicator of the person’s ability? I remember when I was a freshman in high school, and I struggled with Algebra I. I couldn’t catch on no matter what. The teacher was great, she knew her stuff, and she did everything to try and get me through this subject. I ended up failing the class. I told my dad that I would take the class again in my sophomore year, because back then you only needed to take three years of math. He wouldn’t hear of it, and he made me go to summer school. In summer school I really got a grasp of the subject matter. My grade was still only a C, but I really understood the material. I had mastered the content. When I took algebra two during my sophomore year I received a final grade of an A. That was one A that I felt I really earned. I felt good about the A, but I felt even better that I really knew the subject matter. A student can earn an A in a class for a lot of reasons. He/she may be a very hard worker and really apply himself/herself. The teacher may be benevolent and award A’s to most or all of the students, the student might cheat on tests and quizzes, or the teacher may have cooperative groups set up in his/her classroom, which allows for group work to be turned in with everyone receives the same grade. In the last 20 years, the grading system has become progressively more liberal. Teachers almost never fail students anymore. I think two of the biggest reasons why the grading system in schools has become so liberal is because of parental pressure, and because teachers have been told by administration that they can’t fail kids. Parents who have kids in high school know of the competition that’s out there to get into good colleges. If their son/daughter receives a B in a class, they know it could throw of their child's class ranking and their child might not be able to get into the college of their choice. Teachers fear giving a low grade because district scrutiny says that if they fail too many students, those failing grades are reflection poor teaching. Society views good grades as an indicator of student success. The current brain research tell us that in order to determine if a child has mastered school related material they have to show that they retained the information 24-48 hours after they have been given a test. If a student takes a social studies test on WWII and receives a grade of an A, does that mean that he/she has mastered the content? The only way to be really sure is to test the student again in a day or two. This is very unrealistic and I could never imagine any school doing this. I have a friend whose son is attending Dartmouth College. I know that he never worried about his grades and neither did his mother. He was more concerned about learning the content of the course. The good grades came as a result of his attitude about learning. I don’t believe that he measured himself based on grades, but rather on how much he learned and remembered. When he took a class he always tried to figure out what he was going to get out of the teacher, or out of a textbook if the teacher wasn't too good. It didn’t matter to him how the material was taught, and it certainly didn’t matter to him if the teacher was good or if the teacher was bad. He applied himself as a student and he himself worked to master the content. Successful people don’t really worry about a grade; they are more concerned about what they are going to learn. Knowledge to them is sacred, and they work to get as much of it as they can. Grades create competition and that’s a good thing. Good colleges are filled with good students who have worked hard to get where they are and who want to stay where they are. Excellent students like receiving A’s, but they know that that the grades they have received are only an indication that they have truly mastered the material that was taught.

Calvin johnson 2007 draft day picks
Born on September 25, 1985 in Tyrone, Georgia, Calvin Johnson has grown into one of the best college football wide receivers of all time. His rare combination of speed, size, strength, and athletic ability make him difficult to guard no matter who is lining up opposite him. Johnson stands 6 foot 5 inches tall, and weighs close to 240 pounds. To go along with this he has 4.3 speed, and a vertical leap of more than 47 inches! Johnson started his football career at Sandy Creek High School. As a senior he put up average numbers, but not anything that would blow you away. During his senior season Johnson pulled in 40 balls totaling 736 yards. He added a modest eight touchdowns on top of this. His career high school numbers were 80 catches for 1,479 yards and 18 touchdowns. Despite not having the best stats among high school receivers, college coaches came from all over to see what Johnson had to offer. Of course, the main reason for this was his huge upside potential. During his senior year he was pegged as one of the top 10 players in the entire country, as well as one of the best in the state of Georgia. This led to a highly contested recruiting war which was eventually won by the Georgia Institute of Technology, or Georgia Tech as it is also known. During his time at Georgia Tech Johnson made a name for himself. In fact, many people believe he is the best receiver to ever play at the school; and that is saying a lot considering the players who have come before him. In three seasons as a wide receiver at Georgia Tech, Johnson totaled 2,927 yards on 178 receptions. He also contributed 28 touchdowns. After losing to the West Virginia University Mountaineers in the 2007 Toyota Gator Bowl, Johnson declared himself eligible for the upcoming NFL Draft.
